The Department of Justice got it in before the 6 p.m. deadline asking a federal appeals court to restore President Trump's ban on travelers from 7 terrorist-spawning countries. This is the latest barrage in a legal battle which could end up being decided by the Supreme Court.
The filing was with the liberal-leaning Ninth Circuit Court of Appeals and it came three days after bow tie wearing liberal U.S. District Court Judge James Robart's order to basically ban he ban. The DoJ calling Robart's order "vastly overbroad," as if that were a real word, and said the president's executive order was "a lawful exercise of the President's authority over the entry of aliens into the United States and the admission of refugees."
The appeals court didn't immediately reinstate Trump's order and attorneys for Washington and Minnesota, both states who are challenging it, argued that any resumption of the order would "unleash chaos again," separating families and stranding university students [and eventually ending civilization as we know it].
Oral arguments were set for Tuesday afternoon [when Bill Clinton heard the first word, he wanted to be part of the action] and whatever the appeals court decides, either side can then ask the Supreme Court to step in.
With the death of Justice Scalia and the Supreme Court 4 to 4 regarding liberals to conservatives, it may prove difficult to overturn a lower court order because if they split, the lower court gets the call.
The truth of the matter is that Robart's ruling was a political one, not an impartial legal ruling. The guy stands behind Black Lives Matter over the police. Hopefully Trump's administration will win out because the security of the country really is tenuous considering that ISIS made it clear of their intentions to infiltrate the immigration/refugee population with their terrorists.
